California’s Safe Drinking Water and Toxic Enforcement Act of 1986 – commonly referred to as “Proposition 65” or “Prop 65” – requires businesses with ten or more employees to provide a clear and reasonable warning before exposing an individual to certain chemicals. Prop 65 has become a cottage industry for private enforcers and their attorneys, forcing many California businesses to incur significant costs to respond to claims of missing or inadequate warnings.
San Francisco-based law firm Farella Braun + Martel LLP will provide an overview of Prop 65, compliance issues, and strategies for responding to a “60-Day Notice of Intent to Sue” from a private enforcer.
